All related content, memberships, subscriptions, indicators, metrics, blogs, educational material, and services (collectively, the “Services”).

This Agreement is enforceable even though it is electronic and not physically signed.

2. AGE & LEGAL CAPACITY

You must be at least 18 years old and legally capable of entering binding contracts. By using the Services, you represent and warrant that you meet these requirements.

3. EDUCATIONAL PURPOSE ONLY — NO FINANCIAL, INVESTMENT, OR TRADING ADVICE

All content provided through the Services reflects personal opinions, speculation, and educational commentary regarding cryptocurrency markets.

We do NOT:

Act as financial advisors
Provide investment recommendations
Offer portfolio management
Guarantee profits or outcomes

Limited Discretionary Exceptions

5. BILLING, PAYMENTS & FRAUD PREVENTION

You authorize charges to your selected payment method. We reserve the right to:

Change pricing at any time
Cancel or refuse orders
Require identity verification for high-risk transactions

6. INTELLECTUAL PROPERTY & USAGE RESTRICTIONS

All indicators, metrics, charts, code, designs, content, branding, and materials are the exclusive property of TRADE CONFIDENT LLC or its licensors.

STRICTLY PROHIBITED:

Sharing or redistributing content
Screenshots or recordings without written permission
Republishing metrics without visible attribution

Violations may result in termination and legal action.

7. USE OF TRADINGVIEW INDICATORS

We are permitted to incorporate TradingView built-in indicators as components within proprietary indicators.

Customers pay for custom coding, analysis, structure, and presentation, not standalone TradingView indicators.

8. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

We disclaim all warranties, express or implied, including:

Accuracy
Reliability
Merchantability
Fitness for a particular purpose
Non-infringement

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

TRADE CONFIDENT LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Total liability shall not exceed the greater of $1 or the amount paid by you in the prior 30 days.

10. INDEMNIFICATION

You agree to indemnify and hold harmless TRADE CONFIDENT LLC from any claims, damages, losses, or legal fees arising from your use of the Services or violation of this Agreement.

11. MANDATORY ARBITRATION AGREEMENT

All disputes shall be resolved exclusively through binding arbitration, administered by the American Arbitration Association (AAA) and governed by the Federal Arbitration Act.

12. CLASS ACTION WAIVER

You waive any right to participate in:

Class actions
Collective actions
Representative proceedings

All claims must be brought individually.

13. GOVERNING LAW

This Agreement is governed by the laws of the State of California.

14. TERMINATION & REFUSAL OF SERVICE

We reserve the right to suspend or terminate access at any time and refuse service to anyone for any lawful reason.
