Effective Date: October 8, 2026
Please read these Terms carefully. In short:
- Your paid membership renews automatically each billing period (monthly or yearly) until you cancel. You can cancel online anytime (Section 6).
- All sales are final, except as described in our Refund Policy or required by law (Section 7).
- Our content is general market commentary and education, not personalized investment advice (Section 3).
- Disputes are resolved by individual binding arbitration, not class actions or jury trials. You can opt out within 30 days (Section 18).
1. Who We Are and This Agreement
These Terms of Service ("Terms") are an agreement between you and Trade Confident LLC, a California limited liability company located at 418 Broadway St, Chico, CA 95928 ("Trade Confident," "we," "us," or "our").
They govern your use of tradeconfident.io, our indicator page at tradeconfidentportal.io/indicators, our store at tradeconfident.gumroad.com, and our newsletters, posts, videos, live calls, community channels, charts, indicators, downloads and related content (together, the "Services").
Trade Confident LLC also owns and operates PortfolioTA.com. PortfolioTA is governed by the terms and privacy policy posted on that site, not by these Terms.
Our Privacy Policy, Refund Policy and Disclaimer are part of these Terms. By creating an account, subscribing or using the Services, you agree to all of them. If you don't agree, please don't use the Services.
2. Eligibility
To use the Services you must:
- be at least 18 years old and able to enter a binding contract;
- not be located in, or a resident of, a Restricted Jurisdiction (Section 5); and
- not be named on any U.S. government sanctions or restricted-party list, or located in a country or region subject to comprehensive U.S. sanctions.
3. What the Services Are, and Are Not
The Services are the personal market commentary, opinions and educational content of Travis Martin and the Trade Confident team. They cover cryptocurrency, stocks, ETFs, precious metals and the broader markets.
Our content is general and impersonal. We publish the same content to all subscribers, and it is not tailored to anyone's finances, goals or risk tolerance.
We are not an investment adviser, broker-dealer, commodity trading advisor, financial planner, tax adviser or attorney. We are not registered with the SEC, CFTC, FINRA, NFA or any state or foreign financial regulator. Using the Services does not create an advisory, fiduciary or client relationship.
We do not manage money, hold funds or assets, execute trades, or give individualized recommendations. This applies everywhere, including live calls, Telegram, email and direct messages. If you ask about your own situation, we may answer only in general educational terms.

4. Your Account
Please give accurate information and keep your sign-in email secure. Each membership is for one person. You may not share your login, forward paid emails, or give others access to paid content. You are responsible for activity on your account. Tell us promptly if you think someone else is using it.
5. Where the Services Are Available
Places we don't sell to. We don't sell memberships, the Full Access Pass, indicators or any other product to anyone located in or residing in Cuba, Iran, North Korea, Syria, Russia, Belarus, or the Crimea, Donetsk or Luhansk regions of Ukraine, any other country or region subject to comprehensive U.S. sanctions, or to anyone on a U.S. government sanctions list ("Restricted Jurisdictions").
Website checkout. Our website's membership checkout isn't available to people located in or residing in:
Bahamas, Bahrain, Bangladesh, Chile, Iceland, India, Indonesia, Japan, Kenya, Mexico, Moldova, Nigeria, Norway, Oman, Peru, Philippines, Saudi Arabia, South Africa, Taiwan, Thailand, Ukraine, United Arab Emirates, and the Canadian provinces of Quebec and Manitoba.
If you live in one of these places, you can buy the lifetime Full Access Pass through our Gumroad store instead (see Section 6), as long as you are not in a Restricted Jurisdiction. We may update either list at any time by updating these Terms.
Don't use a VPN, false address or someone else's payment method to get around these limits. If we learn that a customer is in a Restricted Jurisdiction, we may end their access. If we learn that a website member is in a place where our website checkout isn't available, we may cancel the membership and offer the Full Access Pass instead. Any refund in either case is at our discretion and subject to the law.
6. Subscriptions, Billing and Automatic Renewal
Billing. Paid memberships are billed in advance, in U.S. dollars, either monthly or yearly depending on the plan you chose. Payments are processed by Stripe through our membership platform. You authorize us to charge your payment method for each billing period.
One-time purchases. Indicators, the Metric Chart Suite and other digital products are sold as one-time purchases through Gumroad, which processes the payment and delivers the product. They do not renew. Gumroad's own terms also apply to that checkout.
Lifetime Full Access Pass. The Full Access Pass is a one-time payment, sold through our Gumroad store, that gives one person access to our paid membership. It does not renew, and you will not be billed again. "Lifetime" means for as long as Trade Confident LLC operates its paid membership, not for the life of the buyer. The pass is personal and non-transferable: it covers one account, and the login and content may not be shared. After you check out, email us the address you want on the pass and we will activate it, usually within 2 business days. The pass does not include indicators, which are sold separately. What the membership includes may change over time, as described in Section 13. We may end a pass if you break these Terms, as described in Section 14. If we ever permanently discontinue the paid membership, we will email pass holders at least 30 days before it closes. The automatic renewal terms below do not apply to the Full Access Pass.
AUTOMATIC RENEWAL. Your membership will automatically renew at the end of each billing period (every month for monthly plans, every year for yearly plans), and your payment method will be charged the price of your plan (plus any applicable tax), until you cancel.
How to cancel. You can cancel anytime online: sign in at tradeconfident.io and go to Account → Plan → Cancel subscription. You may also cancel by emailing betradeconfident@gmail.com. Cancellation takes effect at the end of your current billing period. You keep access until then, and you won't be charged again. There is no cancellation fee, and we will never require a phone call to cancel.
Price changes. If we change the price of your membership, we will email you at least 7 days, and no more than 30 days, before the new price applies. The email will explain how to cancel. If you don't cancel before the new price takes effect, it will apply to your next renewal.
Annual reminder. At least once a year, we will email you a reminder of your membership terms, the amount you are charged, how often you are billed, and how to cancel.
Yearly plans. If you are on a yearly plan, we will also email you at least 15 days and no more than 45 days before each renewal, with the renewal date, the amount, and how to cancel.
Failed payments. If a payment fails, we may retry it and may pause your access until it succeeds.
Taxes. Prices do not include taxes unless stated. You are responsible for any taxes that apply to your purchase.
Records. We keep records of your agreement to these renewal terms as required by law.
7. Refunds
All sales are final. Our Refund Policy explains the limited cases where we issue refunds, and it is part of these Terms.
8. Our Content and Your License
All content in the Services, including posts, videos, charts, metrics, indicators, code, downloads, call recordings, logos and branding, belongs to Trade Confident LLC or its licensors and is protected by copyright and other laws.
While your membership is active, we give you a limited, personal, non-transferable license to view and use the content for your own non-commercial use.
You may not:
- copy, resell, redistribute, publicly post, or share paid posts, videos, call recordings, indicators, code or downloads;
- post screenshots or recordings of paid content, except as allowed below;
- scrape the Services, reverse-engineer our indicators, or remove copyright notices; or
- use our content to train or build artificial intelligence models.
Allowed sharing: you may publicly share a single chart or a brief excerpt for non-commercial purposes if you credit Trade Confident and link to tradeconfident.io.
If you break these rules, we may end your membership without a refund and pursue other remedies.
9. Indicators
Some of our indicators use built-in TradingView functions or indicators as components. What you pay for is our custom code, configuration, analysis and presentation, not any standalone TradingView feature.
Purchased source code. If you buy indicator or chart source code, you receive a lifetime, personal, non-transferable license to use that code for your own analysis, whether or not you have a membership. You may not share, resell, publish or redistribute it, or use it in any other membership, group or service. The code depends on TradingView and outside data sources; if they change, some code may stop working as designed. We may, but are not required to, provide updates.
Indicators run on third-party platforms such as TradingView, under those platforms' own terms. We don't control their data, uptime or pricing. Our indicators are designed not to change signals after a bar closes, but the platform's data provider can revise past prices, which can change past indicator values.
Indicators are analytical tools. Their outputs are not trading signals, recommendations or instructions. We may change or retire indicators at any time.
10. Live Calls and Community Channels
Zoom calls. Monthly calls are for paid members. Calls may be recorded and shared with members. By joining, you agree to the recording of your name, voice, video and chat messages. You can join with your camera off and a display name of your choice.
Telegram. Our Telegram channel is free and open to anyone. Anything you post there can be seen by others and is also governed by Telegram's terms.
Conduct. In all our channels, don't harass others; spam; promote other paid groups, signals or products; promote pump-and-dump or other manipulative schemes; share other people's personal information; or impersonate anyone. We may remove content or members at our discretion.
Beware of impersonators. We will never message you first to ask for money, crypto, wallet keys or seed phrases, or offer to manage or trade your funds. Anyone doing so is not us. Please report it to betradeconfident@gmail.com.
11. Content You Submit
You keep ownership of comments, messages, questions and other content you submit. You give us a non-exclusive, royalty-free license to host, display, and use it in connection with the Services. If you send us a testimonial, you agree that we may publish it with your first name or initials. We will not edit a testimonial in a way that changes its meaning. You are responsible for what you submit, and we may remove it.
12. Third-Party Services and Links
The Services link to and rely on third-party services such as TradingView, Zoom, Telegram, YouTube, exchanges and data providers. We don't control them and aren't responsible for their content, availability or practices. Your use of them is governed by their own terms.
13. Changes to the Services
We may add, change or remove content, features, indicators or schedules at any time. If we permanently discontinue paid memberships, we will cancel all subscriptions so that no further charges occur, and we will email Full Access Pass holders at least 30 days before the membership closes. Our Refund Policy explains how that affects refunds.
14. Suspension and Termination
We may suspend or end your access if you break these Terms, misuse the Services, act fraudulently, file a chargeback for a charge that is consistent with our policies, or where required by law. If we end your membership or Full Access Pass for breaking these Terms, you are not entitled to a refund. You may stop using the Services and cancel at any time.
15. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We do not promise that the Services will be uninterrupted, error-free, or that any content is accurate, complete or current. Some jurisdictions don't allow these exclusions, so some may not apply to you.
16. Limitation of Liability
TO THE FULLEST EXTENT ALLOWED BY LAW:
- We are not liable for any trading or investment losses, or for any decision you make based on the Services.
- We are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill.
- Our total liability for any claim related to the Services is limited to the greater of $100 or the amount you paid us in the 12 months before the claim arose.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or willful misconduct. Some jurisdictions don't allow certain limitations, so some may not apply to you.
17. Indemnification
You agree to defend and indemnify Trade Confident LLC, its owner, team members and contractors against claims, losses and reasonable legal fees arising from your breach of these Terms, your misuse of the Services, or your violation of any law or anyone else's rights.
18. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
a. Talk to us first. Before starting any formal dispute, email betradeconfident@gmail.com and mail written notice to 418 Broadway St, Chico, CA 95928, describing the problem and what you want. We will try to resolve it informally. If we can't within 30 days, either of us may start arbitration.
b. Binding individual arbitration. Except as stated below, any dispute between you and us related to the Services or these Terms will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. Hearings will take place by video or phone, or in person in the county where you live or in Butte County, California, at your choice. Fees are allocated as the AAA Consumer Arbitration Rules require. The arbitrator may award the same individual relief a court could.
c. Exceptions. Either of us may bring an individual claim in small claims court. Either of us may go to court to stop infringement of intellectual property. A claim for public injunctive relief under California law will be decided by a court, after any arbitrable claims are resolved.
d. Class action and jury waiver. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective or representative action. You and we each waive the right to a jury trial.
e. Mass filings. If 25 or more similar arbitration demands are filed by or with the help of the same law firm or group, the AAA may administer them in batches of up to 25, and the parties will cooperate in good faith to resolve them efficiently.
f. 30-day opt-out. You can opt out of this arbitration agreement by emailing betradeconfident@gmail.com within 30 days after you first agree to these Terms. Include your name, account email and a statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
g. If this section is unenforceable. If the class action waiver is found unenforceable for a claim, that claim will proceed in court, not arbitration. Any claim not subject to arbitration will be brought in the courts described in Section 19.
h. Changes. If we change this section, the change won't apply to a dispute you have already notified us about.
19. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules, and by the Federal Arbitration Act. Any court case allowed under these Terms will be brought in the state or federal courts serving Butte County, California, and you and we consent to their jurisdiction.
If you are a consumer outside the United States, nothing in these Terms takes away mandatory protections you have under the law of the country where you live.
20. Electronic Communications
You agree to receive notices, receipts and other communications from us by email and on the website. These satisfy any requirement that communications be in writing.
21. Changes to These Terms
We may update these Terms. If we make a material change, we will notify you by email or on the website at least 14 days before it takes effect. If you continue using the Services after that date, the updated Terms apply. If you don't agree, you can cancel before that date. The "Effective Date" at the top shows when these Terms last changed.
22. General
These Terms, with the policies they include, are the entire agreement between you and us about the Services. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. You may not transfer these Terms; we may transfer them in connection with a sale or reorganization of our business. We are not responsible for delays caused by events beyond our reasonable control.
23. Notice to California Residents
Under California Civil Code Section 1789.3, California users are entitled to this notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
